General regulations

The Mad Bomber® trademark (hereinafter referred to as Mad Bomber®) provides a guarantee for all its products in accordance with the Law of Ukraine "On the Protection of Consumer Rights" directly to consumers.

A consumer is a natural person who purchases, orders, uses or intends to purchase or order products for personal needs not directly related to business activities or the performance of the duties of an employee.

For seasonal goods (clothing, fur and other products), the warranty period is calculated from the beginning of the corresponding season, which is established by the Cabinet of Ministers of Ukraine.

Warranty periods

Mad Bomber® treats its Consumers with understanding, takes into account their risks and needs, is confident in the high quality of its products and provides a warranty for its products longer than the period provided by the current legislation of Ukraine, given above, namely:

Mad Bomber® products that were ordered and purchased directly from Mad Bomber® on the manufacturer's official website https://madbomber.com.ua are covered by the maximum warranty for the period called "Extended Warranty" and indicated on the manufacturer's website in the characteristics of each individual product, but not less than 120 days;
Mad Bomber® products, which were ordered and purchased from Mad Bomber® official representatives on the territory of Ukraine, are provided with a basic period-based warranty, which is called "Warranty" and states:

in the case of sales through online stores - on the seller's website in the characteristics of each individual product, but not less than the warranty period indicated on the product label;
in case of sale through retail sales points - on the marking of the product.

Methods (options) of fulfilling warranty obligations

Mad Bomber® warranties are provided by the following methods:

repair of products at the expense of Mad Bomber®;
replacement of products with a similar new one at the expense of Mad Bomber®;
a partial or full refund of Mad Bomber® products.

Distribution of warranty obligations

The warranty covers defects in Mad Bomber® products that are related to manufacturing defects and are not the result of normal use of the product for its intended purpose.

The normal use of the product is the use of Mad Bomber® products for the purpose for which these products were produced, in compliance with the rules of operation and care, which are indicated in the characteristics and/or description of each individual product on the manufacturer's official website. https://madbomber.com.ua

Manufacturing defects are considered:

fabric seam defects that led to the separation of fabric parts from each other;
fabric defects that led to a significant change in the color, elasticity, elasticity, integrity, shape (area) of the fabric;
defects of decorative elements that led to the separation of such elements from the base;
fastener defects affecting the possibility of their intended use.

Not considered manufacturing defects:

Any of the defects caused by improper use of the product, namely:

using the product not for its intended purpose;
using a product that does not fit the user in terms of size;
using the product during a negative impact on the product or causing a negative impact on the product.

The procedure for consideration of warranty cases

All comments regarding the quality of products during the warranty period and statements regarding the implementation of warranty obligations for Mad Bomber® products are accepted through any communication channels indicated on the official website of the Mad Bomber® manufacturer, in the "Contacts" section.

Applications are accepted for consideration, which contain:

a photo of the product with a manufacturing defect;
a document confirming the date of purchase of the product;
a document certifying the identity of the applicant;
a brief description of the nature of the defect and the situation during/after which the defect occurred/appeared.

Review of disputed issues regarding defects and fulfillment of warranty obligations for Mad Bomber® products

When dealing with any complaints regarding the quality of Mad Bomber® products, regardless of where they were purchased, the Mad Bomber® brand will be loyal to the customer, prioritizing the customer's beliefs and needs.

The Mad Bomber® trademark reserves the right, at its own discretion, to evaluate the reasons that caused a product defect in each individual case, and in case of doubt regarding the proper fulfillment of the warranty conditions by the customer, refer to the warranty periods specified in the current legislation of Ukraine for a specific type of product. That is, to fulfill warranty obligations only during the periods established by the Law of Ukraine "On the Protection of Consumer Rights".

If the client is not satisfied with the decision of the Mad Bomber® regarding the latter's fulfillment of its warranty obligations, the client has the right to resolve this issue in accordance with the procedure established by the Legislation of Ukraine.

1. Legend

1.1. The Terms of Use (Terms) is a public offer (public contract) between the Site administration and the User.

1.2. The site is a collection of logically connected hypertext information, designed as separate pages and available on the Internet at https://madbomber.com.ua, intended for sale by the Seller and purchase of goods by Users using the Internet, which is the Internet shop.

1.3. Online store - means a store presented in the form of a Website, which carries out trade on the Internet and is located at the address https://madbomber.com.ua.

1.4. The seller is the authorized representatives of the Site, including its administration, employees, owner.

1.5. User – a person or a group of persons (regardless of their status) who perform any actions on the Site or with the help of the Site, including: viewing content (any information), copying content, performing: ordering, paying for orders, receiving orders, leaving feedback, any interaction with the seller.

2. General regulations

2.1. These Terms determine the terms of use by the User of materials and services of the Site https://madbomber.com.ua.

2.2. These Terms correspond to Art. Art. 633, 641 and Ch. 63 of the Civil Code of Ukraine and is a public contract (offer) addressed to an unspecified circle of persons, regardless of status (natural person, legal person, natural person - entrepreneur), who perform any actions on the website https://madbomber.com.ua

2.3. Since these Terms are a public offer, by accessing the materials of the Site, the User is considered to have joined these Terms by default.

2.4. The Seller has the right to unilaterally change these Terms and Conditions at any time. New or amended Terms and Conditions become effective after they are posted on the Site. If the User disagrees with the changes made to the Terms, with a part of the Terms, with the Terms as a whole, he is obliged to refuse access to the Site, stop using the materials and services of the Site.

2.5. The user agrees to the Terms in general and, in particular, without reservations, including when placing an order on the Site.

2.6. The user agrees that he understands all the terms of these Terms and accepts them in full.

3. Registration on the Site

3.1. To form orders on the Site, the User can go through the registration procedure and enter the necessary data according to the questionnaire.

3.2. When registering on the Site, the User undertakes to provide reliable and accurate information about himself and his contact data for the Site Administration to fulfill its obligations to the User, including for delivery of goods.

3.3. In the process of registration on the Site, the User specifies a login (his e-mail) and a password, the security of which he is responsible for. The user undertakes not to disclose the login and password specified during registration to third parties, to store this data in a place inaccessible to third parties. The User is solely responsible for all actions performed on his behalf, i.e. using his login and password.

4. Privacy and Personal Data

4.1. Information provided by the User is confidential. The site administration uses information about the User to fulfill Orders, marketing activity only within the Site.

4.2. By filling out the registration form on the Site, the User voluntarily consents to the collection and processing of his personal data by the Seller for the following purpose: the data provided by the User during registration on the Site will be used to process orders for the purchase of goods, receive information about the order, send communications via telecommunications communication (by e-mail, mobile phone, etc.) with advertising and special offers, information about promotions, sweepstakes or any other information about the activities of the Site and for other commercial purposes.

4.3. For the purposes provided for in this clause, the Seller has the right to send letters, messages and materials to the User's postal address, e-mail, as well as send SMS messages, send messages through other communication channels, make calls to the number specified in the application form, if it necessary to fulfill the order. The Seller has the right to record phone calls with the User in order to improve the quality of the latter's service, to which the User gives his unconditional consent.

4.4. The User consents to the Seller's use of cookie technology. Cookies do not contain personal information and cannot in any way read information on the User's hard drive. Cookies are used to improve the quality of the services provided, including: to quickly identify the User, save the User's settings, his personal preferences, track the state of the User's access session and trends characteristic of him. The seller also uses cookies for advertising purposes, including to manage ads on other sites on the Internet. In case of disabling the cookie technology by the User, the Seller does not guarantee the full functionality of the Site or some of its services.

4.5. The User gives the Seller the right to process his personal data, including: to place personal data in the Seller's databases (without additional notification about this), to carry out lifelong storage of such data, their accumulation, update, change (if necessary). The Seller undertakes to ensure the protection of data from unauthorized access by third parties, not to distribute or transfer data to any third party (except for the transfer of data to related parties, commercial partners, persons authorized by the Seller to carry out direct data processing for the specified purposes, and also at the mandatory request of the competent state body).

4.6. In case of unwillingness to receive newsletters about promotions, new products, etc., the User has the right to refuse it by sending a letter to the Seller and/or disabling this function in the personal account.

4.7. The Seller is not responsible for the content and authenticity of the information provided by the User when registering on the Site and placing an order. The User is responsible for the accuracy of the information provided during registration on the Site and when placing the Order, and accepts all the risks associated with the inaccuracy of such information.

5. The order processing, pricing, exchange, return.

5.1. The user can place an order by himself, by pressing the button "buy" and/or "place an order", or by calling the phone number indicated at the top of the page, in a conversation with the seller. After placing the order, the User will be sent a message about the confirmation of the order, to the contacts indicated when placing the order, and about the availability of the product or about the estimated date of arrival of the product in case of its absence. When placing an order by phone, the notification is carried out via the phone from the seller's words.

5.2. In the event of the absence of the product specified on the Site due to technical problems, as well as for other reasons beyond the control of the Seller, the specified order is canceled in whole or in part, and the User is informed by sending him a message by any means chosen by the Seller.

5.3. By joining these Terms and placing an order, the User confirms that he is familiar with the "Delivery and payment", "About the store", "Terms of use of the site" sections of the Site, agrees with them and fully understands them. The Seller reserves the right to change the delivery date of the order with the User's notice.

5.4. The user agrees that the price of the product placed by him in the "basket", its assortment and quantity will be relevant only at the time of formation of the "basket" and may change if the purchase has not been finalized by pressing the button "place order", " to buy".

5.5. The User agrees that the Goods purchased by him are not subject to exchange and return in the following cases:

5.5.1. More than 14 calendar days have passed since the purchase of the Product;

5.5.2. 14 calendar days have not passed since the purchase of the Product, but the product was in use, the integrity of the packaging and/or completeness was violated, there were no tags/price tags, etc.

5.5.3. The product is included in the list of products that are not subject to return and exchange, according to Resolution of the Cabinet of Ministers of Ukraine No. 172 of March 19, 1994 (as amended).

5.6. The user refuses to provide photos of defective and/or faulty goods in his opinion.

5.7. The user confirms his awareness that only new goods that have not been used and have no signs of use: scratches, chips, scuffs, must be preserved: a complete set of goods, integrity and all components of the package, labels, factory marking and the user has the original document confirming the purchase of the corresponding Product. Violation of any of these clauses entitles the seller to refuse the exchange or return of the product to the User.

5.8. If the User rejects the product, the Seller returns to the user the amount paid by the User when paying for such product, with the exception of the Seller's costs for the delivery of the product.

6. Limitation of Seller's Liability

6.1. The seller does not bear any responsibility for any errors, typographical errors and inaccuracies that may be found in the materials contained on the Site. The seller makes every effort to ensure the accuracy and reliability of the information provided on the Site. All information and materials are provided "as is" without warranty of any kind, either express or implied.

6.2. The seller bears no responsibility for the statements and opinions of users of the site, left as comments or reviews.

6.3. The Seller is not responsible for possible illegal actions of Users against third parties or third parties against Users.

6.4. The Seller is not responsible for any loss, damage or expense (actual or possible) incurred in connection with the Site, its use or inability to use it.

6.5. The Seller is not responsible for the User's loss of access to his account on the Site due to the loss of the login, password, other information or for any other reason.

6.6. For the purposes of the above, the Seller reserves the right to delete information posted on the Site and to take technical and legal measures to terminate access to the Site of Users who create problems in the use of the Site by other Users, or Users who violate the requirements of the Terms.

6.7. The seller is not responsible for:

6.7.1. Delays or failures in the process of carrying out the transaction, which occurred as a result of force majeure, as well as any case of problems in telecommunication, computer, electrical and other related systems.

6.7.2. Actions of transfer systems, banks, payment systems and for delays are related to their work.

6.7.3. Proper functioning of the Site, if the User does not have the necessary technical means for its use, and also does not bear any obligations to provide users with such means.

7. Exclusive rights

7.1. All objects available through the services of the Site, including design elements, text, graphic images, illustrations, videos, computer programs, databases, music, sounds and other objects (hereinafter - content), as well as any -what content posted on the site is subject to the exclusive rights of the Seller, Users and other rights holders.

7.2. The use of content, as well as any other elements of the services, is possible only within the framework of the functionality offered by this or that service. No elements of the content of the Site's services, as well as any content posted on the Site's services, may be used in any other way without the prior permission/consent of the right holder. Use includes, but is not limited to: reproduction, copying, processing, distribution on any basis, display in a frame, etc. Exceptions are cases that are directly provided for by the legislation of Ukraine.
